Terms and Conditions for FitPulse

Welcome to FitPulse, developed by Kenny Lee ("I," "me," or "my"). These Terms and Conditions ("Terms") govern your use of the FitPulse App ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years old and agree to these Terms. If you are under 18, you must have parental or guardian consent to use the App. These Terms may be updated, and continued use after changes constitutes acceptance of the updated Terms.

2. Use of the App

The App allows you to:

• Create and manage a user profile (e.g., weight, height, gender).
• Track workouts and running sessions, including metrics like sets, reps, distance, and calories burned.
• Enable exercise reminders via push notifications.
• Use location services to track running routes, if permitted.

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for ensuring your use complies with all applicable laws.

3. User Responsibilities

You agree to:

• Provide accurate information when creating a profile or logging workouts.
• Maintain the security of your device to protect your data.
• Not use the App in a way that could damage, disable, or impair its functionality.
• Not attempt to access, modify, or reverse-engineer the App’s code or data.
• Not use the App while operating a vehicle or in any unsafe manner.

The App is not a substitute for professional medical advice. Consult a healthcare professional before starting any exercise program. You assume all risks associated with physical activities tracked by the App.

4. Intellectual Property

The App, including its design, code, content, and branding, is owned by Kenny Lee and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content without permission.
• Use my trademarks, logos, or branding without written consent.
• Reproduce or create derivative works from the App.

You retain ownership of data you enter (e.g., workouts, profile), but you grant me a non-exclusive, worldwide, royalty-free license to use this data to provide App functionality.

5. Data and Privacy

Your data is handled in accordance with my Privacy Policy. By using the App, you consent to the collection, use, and storage of your data as described therein. Data is stored locally on your device, and I do not share it with third parties except as required by law.

6. Disclaimers

The App is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy of data. I do not guarantee:

• The App will be uninterrupted, error-free, or secure.
• The accuracy of workout metrics (e.g., calories, distance) or location data.
• The App’s suitability for your fitness goals or health conditions.

7. Limitation of Liability

To the fullest extent permitted by law, I shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App, including but not limited to:

• Injuries sustained during workouts or activities tracked by the App.
• Data loss or corruption on your device.
• Errors in notifications or location tracking.

Some jurisdictions do not allow certain liability limitations, so these may not apply to you.

8. Termination

I may suspend or terminate your access to the App at my discretion, with or without notice, if you violate these Terms or engage in unlawful activity. You may stop using the App at any time by uninstalling it, which deletes locally stored data.

9. Governing Law

These Terms are governed by the laws of Hong Kong, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hong Kong.

10. Changes to These Terms

I may update these Terms to reflect changes in the App or legal requirements. Updates will be posted at https://fitpulse-web-0306.web.app/terms_and_conditions.html with a revised effective date. Continued use of the App after changes constitutes acceptance of the new Terms.
